Generally speaking, the statute of limitations for medical malpractice in Virginia is two years from the date of the malpractice or from the last date you treated with the same doctor for the same or a related illness. An exception exists for foreign objects found in your body. Pinpointing the statute of limitations date in a medical malpractice case is very technical. You should always consult an attorney regarding the facts of your case.
 
For minors, generally speaking, the statute of limitations is two years or until the child’s tenth birthday, whichever is longer. In the event a child dies due to medical negligence, the statute of limitations is two years only – the date of the child’s tenth birthday does not matter in such a case.
